Article I — Introduction & Purpose

1.1 — Purpose

These policies and procedures accompany the Declaration of Covenants, Conditions, and Restrictions for the Shadows Lake Subdivision (the “Restrictions”) and assist the Shadows Community Homeowners’ Association (SCHA) with facilitating business and enforcing the regulations and restrictions of the subdivision. The SCHA acts on behalf of the common interest of all neighborhood property owners — primarily to protect, maintain, and enhance the value of Shadows subdivision properties.

1.2 — What These Policies Do

They establish the procedures and rules reasonably necessary to implement the Restrictions; enforce the Restrictions by legal means (all filings); impose fines or penalties for repeated violations; take action against anything done on a lot that is or may become a nuisance or safety hazard; and secure the removal of any unauthorized structure or item from the Shadows common areas.

Article II — Definitions

2.1 — Fine

A sum of money assessed for violation of a restriction or rule.

2.2 — SCHA Property Manager

The contracted management company that assists with neighborhood funds, maintenance, projects, and communications with home and property owners — currently Magnolia Management Services (see Contact below).

2.3 — Violation & Violator

A violation is an infringement of the restrictions or rules. A violator is any person or home/property owner who breaks or fails to comply with a restriction or rule.

Article III — Architectural Control (ACC)

3.1 — Approval Required First

No building, fence, wall, or other structure may be commenced, erected, or maintained on the properties, and no exterior addition, change, or alteration may be made, until plans and specifications showing the nature, kind, shape, heights, materials, and location have been submitted to and recommended for approval in writing by the Architectural Control Committee, with final approval given by the SCHA Board.

3.2 — How to Apply

Submit a Request for Home Improvement Approval form with your contact information, a description of the change, its location on the lot, proposed materials, dimensions, and proposed start and end dates — plus a copy of the lot survey or design drawings. Mail the completed form or submit it electronically to the SCHA email address. The project may not begin until the Board notifies you of approval.

3.3 — Review & Decision

The ACC reviews each request against the Restrictions — with an on-site visit accompanied by a Board member when warranted — and recommends approval or denial to the Board with two ACC signatures. In most cases a final decision is reached within thirty (30) days of receipt. Denials include a written explanation, and approved forms are copied to the homeowner and archived. If thirty days pass without a determination, you may request a meeting with the Board president or designee.

3.4 — City & Parish Permits

The city or parish may require building permits or inspections for your project — that responsibility rests solely with the homeowner, and SCHA approval does not replace any city/parish permitting, approvals, or inspections. Call 225-389-3226 or visit brla.gov for residential permitting information.

IV

Article IV — Notice of a Violation

4.1 — What the Notice Includes

The SCHA Property Manager processes notices of possible violations. The written notice to the property owner states the regulation or restriction in question, the location (and date and time) of the alleged violation, a short and plain statement of the facts, and a recommended remedy or next steps.

4.2 — If It Isn’t Corrected

Failure to enact the remedy or make progress on the recommended next steps may result in a fine under the schedule in Article V, or legal action.

Article V — Enforcement & Fines

5.1 — Initial Warning Letter

A first violation brings an initial warning letter stating the timeframe to come into compliance and your right to submit a written dispute or request a hearing. This step is skipped for repetitious or major violations (see 5.3 and 5.4). If the violation continues past the allotted timeframe, a second letter follows with notice of a fine.

5.2 — Fine Schedule

First violation of a restriction or rule: warning letter. Second, third, and each subsequent violation of the same restriction or rule: a $75.00 fine each. Fourth and subsequent violations may be turned over to the Association’s attorney for appropriate legal action.

5.3 — Repetitious Violations

A series of identical or substantially similar violations occurring willfully and knowingly — each separated by no less than one (1) day and no more than ninety (90) days — is treated as repetitious. After the initial warning letter, each instance may draw its own violation notice and fine, with notice and an opportunity for a hearing; requested hearings may be combined into one.

5.4 — Major Violations

No warnings are given for major violations. Starting renovations without required SCHA Board and ACC approval: a $100–$500 fine depending on the scope of work done. Damage, theft, or vandalism to SCHA property or records: $100 plus the cost to repair or replace. Inappropriate activity in the common areas: $50 plus cleaning costs. Fines do not include other costs incurred by the SCHA, which may be passed on to the violator, and subsequent major violations may be referred to the SCHA attorney.

5.5 — Hearings & Decisions

Request a hearing within ten (10) days of any letter. The Board gives written notice at least ten (10) days before the hearing, which is held within thirty (30) days of your request. Both sides may present evidence, testimony, and witnesses. The Board issues its written findings within fourteen (14) days and may waive all or part of a fine at its discretion. If no hearing is timely requested — or you fail to appear — the Board may decide on the complaint and investigation record alone.

VI

Article VI — Changes to These Policies

6.1 — Revisions & Notice

The SCHA Board may revise these policies and procedures to implement and enforce the Restrictions (all filings). Before major revisions take effect, members receive at least thirty (30) days’ written notice by ordinary mail, and proposed revisions are posted at shadowshoa.com. Technical changes do not require notice. Adopted 05/21/2024, effective 06/01/2024.
